Agreement between C&M Self-Storage LLC and Customer

Welcome to C&M Self-Storage LLC (the "website"). This website is provided solely to assist customers in gathering information about self storage, determining the availability of self storage units plus related goods and services, making legitimate reservations, or otherwise transacting business with self storage space suppliers, and for no other purposes. The terms "we", "us", "our" and "C&M Self-Storage LLC" refer to "www.candmselfstorage.com" and/or our subsidiaries. The term "you" refers to the customer visiting the website, mobile site and/or booking self storage unit reservation(s) through us on this website, via phone, and/or through our agents.

This website and related platforms are offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). By accessing or using this website in any manner, you agree to be bound by the Agreement. If you do not accept all of these terms and conditions, please do not use this website or related platforms. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this website or its related platforms signifies your acceptance of the updated or modified Agreement. Be sure to return to this page to review the most current version of the Agreement.

Use of the Website

As a condition of your use of this website, you warrant that:

  1. You are at least 18 years of age;
  2. You possess the legal authority to create a binding legal obligation;
  3. You will use this website in accordance with this Agreement;
  4. You will only use this website to make legitimate self storage unit reservation(s) for you or for another person for whom you are legally authorized to act;
  5. All information supplied by you on this website is true, accurate, current and complete;
  6. If you make a reservation or otherwise transact online with C&M Self-Storage LLC, you will safeguard your login information and will supervise and be completely responsible for login by anyone other than you. We retain the right at our sole discretion to deny anyone access to this website and the self storage units we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement.

Use of the Mobile Site

C&M Self-Storage LLC’s mobile site is provided in the same way, for the same purposes, and under the same conditions as the website. By accessing or using the mobile site in any manner, you agree to be bound by the Agreement. If you do not accept all of these terms and conditions, please do not use the mobile site.

Use of Digital Call Records

C&M Self-Storage LLC uses technology that records incoming telephone calls. If you initiate a call to one of our tracked phone numbers, we will, at our discretion, create a digital audio recording of the telephone call. We represent and warrant that we have established proper procedures to protect the privacy of all callers in connection with call recording services, and otherwise fully comply with all applicable laws, regulations and governmental or self-regulatory guidelines. A voice alert is played at the beginning of each call to notify callers that the call will be recorded. Our use of the call recording is for quality assurance, customer service, and data tracking purposes only. If you choose to allow yourself to be recorded by continuing with the phone call after the recording notification, you expressly agree and acknowledge that:`

  1. Our employees, contractors, officers, agents, authorized representatives or other trusted third parties may listen to a call that has been recorded on our behalf;
  2. Recording, transcribing, monitoring, analyzing and archiving calls may include, without limitation, the reporting and archiving of personal and non-personal data related to such calls;
  3. You shall determine in advance, in your sole discretion without reliance on us, whether the use of the call recording is appropriate and legal for you. You may elect not to use or to cease use of the call recording.
  4. C&M Self-Storage LLC shall have no liability whatsoever in respect of the call recordings and their contents, including any personal information provided by you or commentary made by you.

Prohibited Activities

The content and information on this website (including, but not limited to, price and availability of self storage units), as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your self storage reservation(s) and related documents for self storage unit(s) booked through this website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or units obtained from or through this website.

Additionally, you agree not to:

  1. Use this website or its contents for any commercial purpose;
  2. Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
  3. Access, monitor or copy any content or information of this website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
  4. Violate the restrictions in any robot exclusion headers on this website or bypass or circumvent other measures employed to prevent or limit access to this website;
  5. Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
  6. Deep-link to any portion of this website (including, without limitation, the rental path for any self storage related information) for any purpose without our express written permission; or
  7. "Frame", "mirror" or otherwise incorporate any part of this website into any other website without our prior written authorization.

Supplier Rules and Restrictions

Separate terms and conditions will apply to any reservation and rental of self storage unit(s) that you select. Please read these separate terms and conditions carefully. You agree to abide by the terms and conditions of rental imposed by any self storage space supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of rates, products, or units. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier's rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable self storage unit(s), in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

Website Copyrights

If you believe in good faith that materials hosted by us infringe your copyright, you (or your agent) may send us a written notice that includes the following information:

  1. A clear identification of the copyrighted work you claim was infringed;
  2. A clear identification of the material you claim is infringing the copyrighted work, and information that will allow us to locate that material on the website, such as a link to the infringing material;
  3. Your contact information so that we can reply to your complaint, preferably including an email address and telephone number;
  4. A statement that you have a "good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law";

Other trademarks, service marks, graphics and logos used in connection with the website may be the trademarks of other third parties. Your use of the website grants you no right or license to reproduce or otherwise use any C&M Self-Storage LLC trademarks or third-party trademarks.

Indemnification

You agree to defend, indemnify and hold harmless C&M Self-Storage LLC, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including legal fees, arising out of your use of the website and services, including but not limited to out of your violation of any representation or warranty contained in these Terms and Conditions.

ADA Compliance Status

storEDGE understands the ethical and legal importance of following the compliance standards of the Americans With Disabilities Act. Because of this, storEDGE is working towards WCAG 2.1 level AA and our fully integrated website platform** already has a very strong start. Below you can find the features of website ADA compliance that apply to our websites, which compliance benchmarks are already met by your website, which are being actively developed within storEDGE and those which storEDGE clients are empowered to implement and monitor on their own. It is important to note that following the success criterion for ADA Compliance is a shared set of tasks between those who wrote the code for the website and those who manage the content of the website. Some success criterion can only be followed by properly structuring the code for the website and some success criterion must be met by the website platform users (those criteria relate to things like uploading images, formatting text content, choosing website colors, etc). This document addresses success criterion that relates to the code base for the platform. Additionally, all testing and updates to ADA criteria implementation are focused on the Google Chrome experience, our preferred and suggested browser. There are 4 major categories that describe the success criterion against which a website can be evaluated for usability; here’s where your fully integrated storEDGE website** stands:

1.Perceivable: Meeting 26 Out Of 29 Success Criterion
Information and user interface components must be presentable to users in ways they can perceive. There are 29 outlined success criteria for the Perceivable accessibility guidelines. Your fully integrated storEDGE website already follows 26 of those 29 standards. There are two items in this category that our development team is actively working on updating to more closely follow the defined standards: 1.1.1: Non-text Content & 1.3.1: Info And Relationships Information and relationships that are implied by visual or auditory formatting are preserved when the presentation format changes. Out of hundreds of areas where a website can have this error, we have found that 6 fields/features on the fully integrated storEDGE website platform** need improvement to fully meet the guidelines. 1.4.3: Contrast (Minimum) Contrast ratio between text and background is at least 4.5:1. While most of the colors on your storEDGE website are managed or directly affected by you, the user, there are a few spots where colors are ‘hard-coded’ (not editable) and will need to be updated by our engineering team. Our design team is working on a replacement and we’ll be making that update very soon.
2. Operable: Meeting 25 Out Of 29 Success Criterion
User interface components and navigation must be operable. There are 29 outlined success criteria for the Operable accessibility guidelines. Your fully integrated storEDGE website already follows 27 of those 29 standards. There is one item in this category that our development team is actively working on updating to more closely follow the defined standards: 2.1.1: Keyboard & 2.4.7: Focus Visible All functionality of the content is operable through a keyboard interface without requiring specific timings for individual keystrokes, except where the underlying function requires input that depends on the path of the user's movement and not just the endpoints and Any keyboard operable user interface has a mode of operation where the keyboard focus indicator is visible. There are just a few points on the website that are inadvertently skipped when users tab through, however all major functions of the website are accessible by keyboard.
2.4.4: Link Purpose (In Context) Help users understand the purpose of each link so they can decide whether they want to follow the link There are just a few elements that must be updated to ensure users are able to understand that a link is provided to a different page or website. 2.4.6: Headings & Labels Descriptive labels help users identify specific components within the content. Again, there are just a few elements that must be updated with a label to ensure users are able to understand the purpose of the element they are focused on.

3.Understandable: Meeting 16 Out Of 17 Success Criterion
Information and the operation of user interface must be understandable. There are 17 outlined success criteria for the Understandable accessibility guidelines. Your fully integrated storEDGE website already follows 16 of those 17 standards. There are two items in this category that our development team is actively working on updating to more closely follow the defined standards: 3.3.2: Labels/Instructions Content authors place instructions or labels that identify the controls in a form so that users know what input data is expected. Again, out of hundreds of fields on the platform, there are a few on which the labels have errors.
4. Robust: Meeting 2 Out Of 3 Success Criterion
Content must be robust enough that it can be interpreted by a wide variety of user agents, including assistive technologies. The Robust criterion set is much smaller, there are only 4 outlined success criteria. Your fully integrated storEDGE website** follows 2 of those 3 standards. The one criterion that needs updates is: 4.1.2: Name. Role, Value For all user interface components (including but not limited to: form elements, links and components generated by scripts), the name and role can be programmatically determined; states, properties, and values that can be set by the user can be programmatically set; and notification of changes to these items is available to user agents, including assistive technologies. Similar to 1.3.1 and 1.4.10, there are hundreds of fields on the platform that this error could apply to, but there are only a few where the development implementation of this feature needs to be updated.
